YESTER, MARION FREDERICK, SR., age 91, passed away on Sunday, November 8, 2009 in Birmingham, Alabama. Mr. Yester was born on August 24, 1918 in Birmingham, Alabama to Margaret and Lawrence Yester. He attended St. Paul's Elementary and High School. He served his country during WWII in the U.S. Navy. Marion married Dorothy Louise Franklin on January 16, 1954. He owned Yester Ceramic Lab for 50 years. He is survived by his loving wife of 55 years, Dot; his sons, Marion Yester, Jr. (Sandy), Matt Yester (Donna) and Jack Yester; his daughters, Mary Margaret Barksdale (Bill), Cathy Lindberg (Jon), Marie Eidson (John Gaines) and Jennifer Peace (Scott); his sister, Bernadine Seay; 15 grandchildren; and three great-grandchildren. The family would also like to thank the nurses and staff of St. Martin's in the Pines and Alacare Hospice for the care they showed to Mr. Yester and the family. The wake will be on Tuesday from 5:00 - 7:00 PM at St. Francis Xavier Church with a prayer service to follow. The funeral mass will be at 10:00 AM on Wednesday at St. Francis Xavier Church. Graveside services will follow at Elmwood Cemetery. In lieu of flowers, donations may be made to the St. Francis Xavier School Endowment, 2 Xavier Circle, Birmingham, AL 35213.

He was preceded in death by his mother, Stella Vest Franklin and father, Rabe Franklin, brothers, Houston, Joe, Ralph Franklin and sister, Veda Ruth Lee Seale. He is survived by his wife of 61 years, Bernice Cole Franklin, sons, William Rabe (Shelia) Sr. and Robert R. (Kim) Franklin Jr "Poncho"; daughter, Vicky Lynn (Kenneth) Robertson; sisters, Marion (Sis) Sertell and Dot (Marion) Yester; brother, Jack (Glenda) Franklin; granddaughters, Cheryl (Wesley) Machen, Lisa (Lee) Evans, Christy Robertson, Brittney Livingstone and Jennifer Kerr; grandsons, William Rabe (Jodie) Franklin Jr. Robert R. Franklin III, and James (Darlene) Ellison; great grandchildren, Christopher Collier, Emily, Hannah Machen, Matt, Nathan, Hailey Franklin, Christopher Kerr, Megan, James, Ashley Ellison, Elizabeth and Joshua Evans. Mr. Franklin was a Loving Husband, Daddy, and Greatpapa. He was a member of Irondale Lodge # 506 and past Master Shrine member of the Convertible Unit, Knights of Mecca B'ham Metro York Rite, Masonic Bodies and Teamster Union #528. He taught many of his brothers their work. He was an instructor in his work to many different Lodges. He was District Lecture #17 in 2005 to 2007. He was also past Patron of East Lake Chapter # 258 O.E.S and Worthy Patron at Cahaba Chapter # 222 O.E.S. The family would like to thank Wiregrass Hospice for all of their care and help and a special thanks to Sylvia, Jennifer, Karen, Lynn and Dawn. Visitation will be Tuesday November 3, 2009 from 5 until 7 P.M. at Ridout's Trussville Chapel. Funeral service will be Wednesday November 4, 2009, 2:00 P.M. at Ridout's Trussville Chapel with interment to follow in Forest Crest cemetery.

(The story is told that GreenBerry served in the place of one of the wealthy landowners in the area. He was promised that if he did, his family would be well taken care of while he was gone. He signed up at Cedar Grove Post Office (or Cedar Grove Baptist Church) and walked up towards Leeds. His family suffered through hardship, the agreement for his services as a substitute was not met.)

 

 

Greenberry owned a farm on Cox's Creek in Jefferson/Shelby County near Lake Purdy. There he raised his family of 10 children. He served in the Civil War sometime between 1864-65 as a Private in the Truss Company, Barbiere's Cavalry Battalion of Alabama. He was injured to some degree. He was a gunsmith. He also worked on the railroad tunnel that was cut through the mountain above Leeds, Alabama.

Barbiere's Cavalry Battalion, Local Defense Troops [Alabama Reserves]

 

Major Joseph Barbiere's Cavalry Battalion was organized in 1864 from several independent companies which had themselves been created as supporting forces for the Conscript Reserves. The battalion served principally in central Alabama during the fall and winter, 1864-1865, and it was first assigned (1 Nov 64) to Armistead's Cavalry Brigade, District of Central Alabama, until January 1865. The unit was headquartered at Wilsonville, AL (Feb 65) and was reported as serving with the Alabama Reserves with six companies ("A"-"F"). It was assigned to, and included in the surrender of the Department of Alabama, Mississippi and East Louisiana by Lt. Gen'l Richard Taylor at Citronelle, AL, on 4 May 1865.

 

Barbiere's Cavalry Battalion consisted of Companies "A"-"E" (probably Capt. John C. Brown's, Capt. J. M.Clifton's, Capt. Dawson's, Capt. Thomas J. Goldsby's, and Capt. Thomas K. Truss' companies), "F" (Capt. Andrew W. Bowie's), and "G" (Capt. P. L. Griffitts)

Researched by Dave Barnes, 2/2000: Widows Pension Application: Private, Truss' Co., Barberrie's Bn. There is a note on the original (!) that a copy was mailed to Eugene E. Ingram, 10/22/74, Bham, Ala. The Pension Application was witnessed by E. J. McDaniel who signed his/her name clearly as E. J. McDanal.

THE FRANKLIN FAMILY

 

The Franklin Family settled someplace in North Carolina, and later made their way to Alabama by wagon train. One family that came with them had the name of "Ware". The story has been told that two or three families came together, and that great, great grandfather Franklin settled around Mud Creek near the Warrior River, southwest of Bessemer. No one knows where the other families settled. Nothing is known of how many children there were in the Franklin family, nor what date they came. It could well have been in the late 1790's or early 1800's.

(The story is told that GreenBerry served in the place of one of the wealthy landowners in the area. He was promised that if he did, his family would be well taken care of while he was gone. He signed up at Cedar Grove Post Office (or Cedar Grove Baptist Church) and walked up towards Leeds. His family suffered through hardship, the agreement for his services as a substitute was not met.)

 

 

Greenberry owned a farm on Cox's Creek in Jefferson/Shelby County near Lake Purdy. There he raised his family of 10 children. He served in the Civil War sometime between 1864-65 as a Private in the Truss Company, Barbiere's Cavalry Battalion of Alabama. He was injured to some degree. He was a gunsmith. He also worked on the railroad tunnel that was cut through the mountain above Leeds, Alabama.

Barbiere's Cavalry Battalion, Local Defense Troops [Alabama Reserves]

 

Major Joseph Barbiere's Cavalry Battalion was organized in 1864 from several independent companies which had themselves been created as supporting forces for the Conscript Reserves. The battalion served principally in central Alabama during the fall and winter, 1864-1865, and it was first assigned (1 Nov 64) to Armistead's Cavalry Brigade, District of Central Alabama, until January 1865. The unit was headquartered at Wilsonville, AL (Feb 65) and was reported as serving with the Alabama Reserves with six companies ("A"-"F"). It was assigned to, and included in the surrender of the Department of Alabama, Mississippi and East Louisiana by Lt. Gen'l Richard Taylor at Citronelle, AL, on 4 May 1865.

 

Barbiere's Cavalry Battalion consisted of Companies "A"-"E" (probably Capt. John C. Brown's, Capt. J. M.Clifton's, Capt. Dawson's, Capt. Thomas J. Goldsby's, and Capt. Thomas K. Truss' companies), "F" (Capt. Andrew W. Bowie's), and "G" (Capt. P. L. Griffitts)

His wife, Arletha McDaniel Franklin, applied for a pension on June 7, 1907, from the State of Alabama for service that her husband rendered during the War Between the States. The pension was granted.

Researched by Dave Barnes, 2/2000: Widows Pension Application: Private, Truss' Co., Barberrie's Bn. There is a note on the original (!) that a copy was mailed to Eugene E. Ingram, 10/22/74, Bham, Ala. The Pension Application was witnessed by E. J. McDaniel who signed his/her name clearly as E. J. McDanal.

THE FRANKLIN FAMILY

 

The Franklin Family settled someplace in North Carolina, and later made their way to Alabama by wagon train. One family that came with them had the name of "Ware". The story has been told that two or three families came together, and that great, great grandfather Franklin settled around Mud Creek near the Warrior River, southwest of Bessemer. No one knows where the other families settled. Nothing is known of how many children there were in the Franklin family, nor what date they came. It could well have been in the late 1790's or early 1800's.

My grandfather used to visit us at Lovick, Alabama, when I was a little girl. I remember him sitting on the front porch in a straight cane chair holding his cane, and telling us stories of hearing the cannon shots that were fired during the War Between the States. He also told us of his parents selling their last slave on the block in Birmingham when Birmingham was not more than a mudhole. He also remembered when the Yankees came through and stole all their horses from the barn. His family lived down the valley from Leeds around Lake Purdy. Grandpa loved to imbibe his bourbon; he would take a drink from his bottle and say "Ah, that's good!" It hurt my mother terribly because he would sometimes drink. He rode his horse up until a few months before he died.

 

"Grandpa Franklin told the story of the time the house flooded - he got the feather bed out and floated away."

State of Alabama Pension Bureau required Sarah to prove that she was entitled to receive widow's pension benefits from Edmond's service in the Civil War. They charged that " E. C. Smith has not been found on the rolls of Co K, 18th, Alabama Infantry, C.S.A." The notice giving her 20 days to provide testimony and affidavits was given on 9 July 1914.

Jeremiah McDaniel / McDanal owned land adjacent to Green Berry in Lake Purdy area. In addition to land Jeremiah entered with the gov't, an entry in the Probate records on 21 Dec. 1835 indicates Jesse Sparks and wife, Mary, sold to Jeremiah McDaniel 239.57 acres, part of which includes the land on which Nichols Cemetery is located: "being the NE 1/4 of Sec. 10, Tp 18S R 1W" in addition to W 1/2 of NW 1/4 of Sec 11 T18S R1W.

The Baptist Conference Obituary Committee notes that they were "distant relatives" both from Kentucky. Assumption is made that Thomas Franklin and Owen Franklin are brothers. Their sons, Owen and Thomas Jr , are both Baptist preachers in Jefferson County. The Baptist Conference Obituary Committee notes that they were "distant relatives" both from Kentucky. W.B. Parsons notes in his history of Rock Creek Baptist Church: " The Presbytery was probably composed of the Franklin Cousins, Thomas and Owen Franklin, who were Baptist Ministers and had moved in from Kentucky." (p. 16)

 

The first purchase of land from the gov't by a Franklin in Jeff co was in Trussville in 1823. Thomas Franklin is listed as the patentee.

Story goes that Angus fought in the battle of Culloden Moor in Scotland, he was captured, found fuilty of treason and sent to Maryland in 1747 on the "Johnson" along with brothers Daniel and John and ?Mary.

Polly has located some descendents of Daniel & John. All of them were sold into actual slavery - not indentured servitude but actual slavery. John escaped somehow, and made his way to Edgefield SC after his son was born in VA. --- Possibly Joseph killed in civil war - (enlisted in 2 different AL regiments.) Children all end up in New Orleans and begin using McDanell spelling.
